  1. General

This is the website of Bread is Beautiful at this following address https://breadisbeautiful.eu as of now “our site” or “our website” or “site”. The present terms and conditions of sale govern the relationship between Bread is Beautiful, registered in Brussels, Belgium, under company number 0895.463.616, and with our registered office at 46 rue des Patriotes, 1000 Bruxelles, operating under the name Bread is Beautiful, hereinafter called the “Vendor” or “Bread is Beautiful” or “we”, or “us”, and any person or company placing an order online on the website https://breadisbeautiful.eu for himself/herself or on behalf of a third party, for private or professional purposes, hereinafter called “the Customer” or “you”.

If you are a consumer then references in these terms and conditions (the “Terms”) to “you” are to the individual using our site and the Services for private and non-commercial purposes. Please read these Terms carefully and make sure that you understand them, before ordering any Services.  Please note that by ordering any of our Services, you agree to be bound by these Terms.

If you are a business, references in these Terms to “you” are to the business that you have the authority to bind in accordance with section 2.

These Terms provide you information about us and the legal terms and conditions on which we provide the services detailed on our site to you. Please read these Terms carefully and make sure that you understand them, before ordering any Services.  Please note that by ordering any of our Services in accordance with section 2, you agree to be bound by these Terms.

These “ Terms” are available in English language only. The fact that the Customer has not received the present “Terms” in his language does not exempt him from applying them. The order of any Product proposed on the site supposes the reading and express acceptance of the present Terms and Conditions, and this acceptance does not require the Customer’s handwritten signature.

We amend these Terms from time to time as set out in section 15. Every time you wish to order Services, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 2 April 2016.

  1. If you are a business customer

This section 2 applies only if you are a business. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use the Services under Order.

The Terms constitute the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between you and us, whether written or oral, relating to its subject matter.

You acknowledge that in entering into agreement with “us” you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in the Terms. You and we agree that neither party shall have any claim for innocent or negligent misrepresentation based on any statement in the Terms.

  1. The Products

The Products are described on the site https://breadisbeautiful.eu in good faith and as accurately as possible. Customers may obtain extra information on the products presented on the site by sending an email to info@breadisbeautiful.eu

The presentation of the product is not binding on the Vendor and does not constitute an offer in the legal sense of the term.

The photographs, drawings or videos illustrating the products are not contractually binding. Under no circumstances shall the Vendor be held liable for any errors that may occur in them.

The information about products and pricing are for information only and may be modified by Bread is Beautiful without prior notice.
We recommend that you do not use the Services if you have any allergies.  If you do have allergies and still wish to use the Services then you do so at your own risk and we shall not be liable in respect of the allergenic content of the Products.  Please contact us using the contact details provided on our site before if you require further information and advice on the allergenic content of the Products. We cannot guarantee and make no warranty that the Products will not contain allergens. They are made in bakeries that use milk, eggs, yeast, wheat and other products and there is a risk of cross-contamination between ingredients. Nutritional information provided is an approximation based on information provided by suppliers and published resources.  We cannot guarantee the exact nutritional information.

They weight of the breads might vary minimally because they are made by hand and cut from a larger loaf into smaller loaves.

The products presented on our STORE may under no circumstances be subject to requests to modify their composition or their presentation.

All Products are subject to availability.

  1. Order

The Products proposed for sale in www.breadisbeautiful.eu are food and as such the Customer does not have the right to revoke the purchase.

The Services shall be performed in accordance with the process set out in this section.

Customers are requested to complete the order form fully and accurately. Should there be any error in the details provided for the recipient or for the amount to pay, we cannot be held responsible for the failure to deliver.

If there is a problem, we will e-mail you within 2 working days (excluding Saturdays and Sundays). In the event that we cannot satisfy your order due to stock unavailability, we will contact you to offer an alternative.

You may open a customer account. If you do not open a Customer Account then you will need to enter your full details every time you use the Services through our site. If you open a Customer Account you shall be issued with a username and password as part of the registration process to open your Customer Account.  You must use all reasonable steps to keep your username and password confidential, and must inform us if you suspect or discover that your username or password have become known to someone else.
You shall use your Customer Account or, if you have elected not to open a Customer Account, the details that we request from you during the ordering process, to place an order for the Services in accordance with the process outlined on our site.

Once the credit card data on the interface of our partner bank has been confirmed, the order is considered as irrevocable. A 0,25 € credit card transaction fee applies to all orders, regardless of the total amount.

For direct bank transfers, the customer must make the payment directly into our bank account using the Order ID as the payment reference. The order will not be shipped until the funds have cleared in our account.

The order is only definitely accepted after confirmation of payment of the amount corresponding to the order.

  1. Pick-up

Pick-up is free of charge. The Customer is requested in the CHECKOUT page to choose one pick-up point and a date of pick-up. The Customer is requested to give his/her name to the staff members at the pick-up point they chose, to be able to collect their order. The Customer must collect their order within the hours indicated on our site for each pick-up point. We can, under no circumstances, be held responsible for any damage to the products resulting from late pick-up on the part of the customer.

  1. Delivery

Delivery is free of charge for purchases of an amount equal or greater than 40€. To be delivered for free, the customer must choose the option Free delivery in the CHECKOUT page and indicate accurately the address of delivery.

Once we have dispatched your Order for delivery, we shall contact you by telephone or email provided in your customer account to inform you when the delivery will be made.

If the recipient or a person able to accept the delivery is absent, the carrier will leave a notification of the delivery at the delivery address indicated by the customer asking him to claim the products. Under no circumstances we can be held responsible for any damage to the products resulting from their late recovery from the carrier.

  1. Prices

The prices indicated on the order form are in EURO and include a VAT of 6%. The prices indicated on this site may be changed due to fluctuations in the costs of raw materials and other factors.

  1. Risk

Risk in the Products shall remain with you from the time of delivery and pick-up.

  1. Payment

To be accepted, your order must be paid for in full. Orders not paid for cannot be delivered or shipped to a pick-up point.

Payment is made online by credit card or by bank transfer (ING).

The amount debited from the account of the credit card or bank account used will depend on the rate of the Euro on the day of the debit and on any exchange costs charged by the bank issuing the card.

A 0,25 € credit card transaction fee applies to all orders, regardless of the total amount.

  1. Storage

Information on how to store the products is given in good faith and is only indicative, humidity and other factors may affect preservation. It’s the customer’s responsibility to store their products properly. Under no circumstances we can be held responsible for any damage to the products resulting from the customer’s storage.

  1. Replacements and refunds

No returns, refunds or replacements will be granted. No claim may be made by the customer concerning the taste, freshness or appearance of the products.

  1. Interdictions

Under no circumstances may the customer sell the products which are intended for his personal use or that of the person to whom the order is made.

  1. Intellectual property

All the texts, comments, illustrations and images reproduced on our website are copyright. All rights are reserved. Any reproduction in part or in full without the Vendor’s consent is prohibited. Ordering does not entail the transfer or granting of intellectual property rights unless expressly stated.

  1. Protection of privacy

The provision of personal information for online sale is compulsory because it is needed to processing orders, shipping and invoicing. This information is strictly confidential. Failure to supply information entails the automatic rejection of the order.

Bread is Beautiful will not divulgate the personal information provided by its Customers to any third parties. It shall be used solely for the purposes of processing, shipping and invoicing the orders, service, solvency, marketing or personalized advertising.

Visitors who wish to do so are entitled to oppose the use of their data for personalized marketing, by simple request and free of charge.

A Customer who placed an order on our site may at any time consult, correct or delete the personal data that our site has recorded about him/her by sending an email to info@breadisbeautiful.eu.

  1. Our rights to vary these Terms

We may revise these Terms from time to time. Every time you place an order, the Terms in force at that time will apply to any corresponding Order.

  1. Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, the Services that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below.
An “Event Outside Our Control” means any act or event beyond our reasonable control including, without limitation, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, snow, flood, earthquake, subsidence, epidemic or other natural disaster, failure of public or private telecommunications networks, impossibility of the use of motor transport or other means of public or private transport, road traffic accidents, road closures or mechanical failure.
If an Event Outside Our Control takes place that affects the performance of the Services:

  • we will contact you as soon as reasonably possible to notify you;
  • we shall not be liable to you as a result of any delay or failure to perform the Services as a result of an Event Outside Our Control; and
  • we shall use reasonable endeavours to minimise any disruption to the Services.
  1. Applicable law and disputes:

These Terms are governed by Belgian law. The customer shall first address complaints to Bread is Beautiful at info@breadisbeautiful.eu with a view to obtaining a friendly settlement. Any disputes shall be settled under Belgian law by the courts of Brussels.

Each of the sections of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining sections will remain in full force and effect.
